Overview

This website is run by Clearly Made, a sole proprietorship based in Tennessee, United States. Throughout the site, "we", "us", and "our" mean Clearly Made.

By visiting the site or buying something from us, you agree to these terms. They apply to everyone who uses the site, including browsers, customers, and anyone who posts content. If you don't agree with them, please don't use the site or place an order.

We can update these terms at any time by posting changes on this page. Check it now and then. Using the site after a change means you accept the new terms.

Our store is hosted on Shopify, which provides the platform that lets us sell to you.

Online store terms

By placing an order, you confirm that you are at least the age of majority in your state, or that you have permission from a parent or guardian for anyone in your care who uses the site.

You agree not to use our products for any illegal purpose, and not to break any law in your jurisdiction while using the site.

You agree not to send worms, viruses, or any code designed to damage the site or anyone's computer.

If you break any of these terms, we can close your access to the site right away.

Product and material information

Every product page has a material profile. It describes what the maker has documented or told us: the material of each surface that touches food, coffee, or water, any coating, the country of manufacture, and anything we couldn't confirm.

Each product carries one overall evidence level that says how we know its food-contact facts. It is set by the least certain fact about the parts that touch food, and anything we couldn't confirm is listed as not stated. "Lab tested" means a laboratory report on that product is on file and summarized on the page. "Manufacturer documented" means we hold a written spec or declaration from the maker. "Manufacturer stated" means the maker says it publicly and we don't hold a document yet. "Reported" means secondary sources only. "Unknown" means the maker hasn't told us and we found no reliable source.

A material profile is not a lab certification unless it is marked Lab tested. Nothing in a profile means Clearly Made tested the product itself.

We don't claim that any product is non-toxic, chemical-free, or safe for every use. We describe materials. Nothing on this site is medical or safety advice. Follow the maker's care and use instructions, and the maker's heat, oven, dishwasher, and microwave limits.

Profiles are reviewed at least every 12 months and the review date is shown. We try to keep every profile accurate and current, but we can't promise the site is free of errors. If you find one, email us and we'll fix it.

Product photos are the maker's or ours. Colors can look different on your screen.

Prices and changes

Prices are in US dollars. Sales tax, where it applies, is added at checkout.

Prices and product details can change without notice. We can change or stop selling any product at any time. We aren't responsible to you or anyone else for a price change, a product change, or a product we stop carrying.

Orders

When you place an order, you're making an offer to buy. We accept it when we send your shipping confirmation.

We can refuse or cancel any order. That can happen if an item sells out at the maker, if we suspect an order is from a reseller or distributor, or if there's a problem with the payment or shipping details. If we cancel after you've paid, we refund you in full.

Inventory is held by the makers and can change. If an item sells out after you order, we refund it in full.

You agree to give us current and complete purchase and account information, and to keep your email and payment details up to date so we can complete your order and reach you if something comes up.

Products shipped by makers and authorized distributors

Most of what we sell ships straight from the maker or its authorized US distributor, not from Clearly Made. Each product page says who ships it and the usual handling time.

If your order includes items from two makers, it arrives as two shipments. Checkout shows a separate shipping line for each.

Clearly Made is the seller of record. The maker packs and ships your item and handles warranty claims after the return window. We'll help you file them.

Shipping and risk of loss

We ship to US addresses only. Some makers don't ship to Alaska, Hawaii, or PO boxes, and checkout tells you if that applies.

Shipping costs and handling times are on the product page and at checkout. Delivery dates are estimates, not promises. If an item can't ship within its stated handling time, or within 30 days when no time is stated, we'll email you with a new date, and you can cancel for a full refund.

Risk of loss and title pass to you when the carrier accepts the package from the maker. If a package arrives damaged, email us within 7 days with photos of the box and the item and we'll arrange a replacement or refund. You won't pay return shipping for damaged or defective items.

Returns and refunds

You have 30 days from delivery to return an item that's unused and in its original packaging. Returns go back to the maker that shipped it. Damaged, defective, or not-as-described items are replaced or refunded at no cost. Change-of-mind returns are charged the actual return shipping. There's no restocking fee.

User comments and submissions

If you send us comments, reviews, suggestions, or other material, whether we asked for them or not, you agree that we can use, edit, publish, and share them in any medium without restriction or payment. We don't have to keep them confidential or respond to them.

We can monitor, edit, or remove anything we judge to be unlawful, offensive, threatening, defamatory, obscene, or in breach of someone's intellectual property or these terms. We aren't obligated to.

You agree that your comments won't violate anyone's rights, won't contain anything unlawful or abusive, and won't carry viruses or malware. You won't use a false email address or pretend to be someone else. You're responsible for what you post.

Personal information

What we collect, how we use it, and how to ask us to access or delete it are in our privacy policy at https://clearlymadegoods.com/policies/privacy-policy. The short version: we collect what we need to process your order and reply to you, we share your shipping details with the maker that fulfills your order and with the carrier, and we don't sell personal data.

Errors and omissions

Now and then the site has a typo, a wrong price, or outdated availability. We can correct errors and update information at any time without notice, including after you've placed an order. If we cancel an order because of a pricing error, we refund you in full.

We don't promise to update any information on the site, except as the law requires. Nothing on the site should be taken as a promise that everything on it has been checked or changed as of a particular date.

Prohibited uses

You may not use the site or its content: for anything unlawful, or to get others to do anything unlawful; to violate any federal, state, or local law or regulation; to infringe our intellectual property or anyone else's; to harass, abuse, defame, or discriminate against anyone; to submit false or misleading information; to upload or send viruses or any other malicious code; to collect or track other people's personal information; to spam, phish, scrape, crawl, or pretend to be someone else; for any obscene or immoral purpose; or to interfere with the security of the site, other websites, or the internet.

If you do any of these, we can end your use of the site.

Disclaimer of warranties and limitation of liability

We don't guarantee that the site will be uninterrupted, timely, secure, or error free. We don't guarantee that results from using the site will be accurate or reliable. We can suspend or remove the site at any time without notice.

Except where we say otherwise in writing, every product and service is provided as is and as available, without any representations, warranties, or conditions of any kind, express or implied, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. Product warranties come from the maker and are quoted on the product page.

To the fullest extent the law allows, Clearly Made and its owner, contractors, suppliers, and service providers are not liable for any injury, loss, claim, or damages of any kind, including direct, indirect, incidental, punitive, special, or consequential damages, lost profits, lost revenue, lost savings, lost data, or replacement costs, that come from your use of the site or any product bought through it. This applies whether the claim is in contract, tort (including negligence), strict liability, or otherwise, even if we were told the damage was possible.

Some states don't allow limits on implied warranties or on incidental and consequential damages. Where that's the case, our liability is limited to the fullest extent the law permits.

Indemnification

You agree to defend and hold harmless Clearly Made and its owner, contractors, suppliers, and service providers from any claim or demand, including reasonable attorneys' fees, made by a third party because of your breach of these terms or your violation of any law or anyone's rights.

Severability

If any part of these terms is found unlawful, void, or unenforceable, that part is enforced to the fullest extent the law allows and is treated as cut from the rest. The rest of the terms stay in force.

Termination

Your obligations and ours from before the termination date survive it.

These terms stay in effect until you or we end them. You can end them by telling us you no longer want to use the site, or by stopping use of it. If we judge, or suspect, that you've failed to follow any part of these terms, we can end this agreement at any time without notice. You stay responsible for any amounts due up to that date, and we can deny you access to the site.

Entire agreement

If we don't exercise or enforce a right under these terms, that doesn't waive it.

These terms, plus our shipping, refund, and privacy policies, are the entire agreement between you and us for your use of the site. They replace any earlier agreements, communications, or proposals, oral or written. Any ambiguity in these terms isn't to be construed against whoever drafted them.

Governing law

These terms and any separate agreement under which we sell to you are governed by the laws of the State of Tennessee and the United States, without regard to conflict of law rules.

Changes to these terms

You can read the current version of these terms on this page at any time. We can update, change, or replace any part of them by posting changes here. It's your responsibility to check this page. Using the site after a change is posted means you accept it.
